Terms of Service
These terms apply to our website (aerositellc.com) and to the services AeroSite LLC ("AeroSite", "we", "us") provides to you ("you", "client"). The specifics of any project (what we will build, the price, and the timeline) are set out in the written proposal you accept. If a proposal and these terms differ, the proposal controls for that project.
1. Our website
You may use this website for lawful purposes. Please do not misuse it, attempt to break into it, or submit someone else's information without their permission. The content on this site (including our name, logo, designs and text) belongs to AeroSite or its licensors and may not be copied without our written permission.
2. Proposals and scope
After a discovery meeting we send a tailored proposal. You decide whether to go ahead; nothing is binding until you accept the proposal. The proposal describes the deliverables, price, payment option and timeline. Work outside that scope, including extra pages, extra revisions or add-ons, is quoted and agreed with you before we do it.
3. Websites: payment, ownership and revisions
- Payment options. Each website package can be paid in full, on the flex plan (a deposit then five payments), or on the launch-now plan (twelve monthly payments). The amounts and dates are in your proposal. Remaining balances can be paid off early.
- Ownership. You own the finished website once it is paid for: when payment in full is received, or after the final payment on a payment plan. Until then AeroSite keeps ownership, and we may suspend or take down an unpaid website. Third-party materials (such as stock images, fonts or plugins) stay under their own licenses.
- Revisions. The package includes the number of consolidated revision rounds stated in your proposal (normally two). A consolidated round means you give us all your changes at once.
- Launch support. We deploy the website and provide 30 days of post-launch technical support, as described in your proposal.
- Third-party costs. Domains, paid plugins, booking software and other subscriptions are confirmed in your proposal and billed separately, or by the provider directly.
- Your content. You are responsible for the text, photos, logos and other material you give us, and you confirm you have the right to use it. Delays in providing content or feedback can delay your timeline.
4. Website care plans
Care plans (Essential Care, Growth Care and Business Partner) are month to month. Billing starts once your website is live. The monthly allowances for edits and work do not roll over to the next month. You can cancel with 30 days' written notice (an email to us is fine). What each plan includes is described on our services page, and may be updated for new clients.
5. Marketing, photo, video and ads
Photo, video, social media and ad management services are described in your proposal. Ad spend is paid separately directly to the advertising platform (such as Meta) from your own funds, in addition to our fees. We do not guarantee any particular number of leads, customers, sales, rankings or other results, because these depend on factors outside our control. Advertising platforms may reject or remove ads under their own rules.
6. Fees and payment
You agree to pay the fees in your proposal on the dates stated. Payment methods we accept are listed in your invoice. Payments for website packages and monthly plans are non-refundable, because design, development and set-up work starts right away; we do not give pro-rated refunds for part months or for cancelled projects (you still owe for work completed, see section 9). If an amount is still unpaid three (3) business days after its due date, a flat late fee of $25 applies. If an invoice stays unpaid for more than seven (7) calendar days after its due date, we may pause work and suspend hosting, form handling and dashboard access after telling you.
7. Our work and your results
We work carefully and professionally, but we provide our website and services "as is". To the fullest extent the law allows, we disclaim all other warranties, including that the website will be uninterrupted or error-free, or that it will produce any particular business result. Our websites and dashboards run on third-party services (including GitHub, Supabase and Hostinger), and lead forms, notifications and automated emails depend on them. We are not responsible for missed or delayed leads, notifications or data, or for losses, caused by outages or failures of those providers or of your own internet, email or devices.
8. Limits on our liability
To the fullest extent the law allows, AeroSite is not liable for indirect, incidental or consequential damages, or for lost profits, revenue or data. Our total liability for any claim connected to our services is limited to the fees you actually paid us in the 6 months before the event that gave rise to the claim, or $1,500, whichever is greater. Nothing in these terms limits liability that cannot be limited by law.
9. Ending our work together
You may stop a project at any time by telling us in writing; you will owe for work completed up to that point. We may end our work if you break these terms or fail to pay, after giving you notice. Sections that by their nature should continue, such as payment, ownership, liability and governing law, continue after we stop working together.
10. Privacy
How we handle your information is described in our Privacy Policy.
11. Changes to these terms
We may update these terms and will change the date above when we do. The version in effect when you accepted your proposal governs that project.
12. Governing law
These terms are governed by the laws of the State of Illinois, without regard to its conflict of laws rules.
